Introduction

Abstract

Politically, South Korea is entrenched in parliamentary disagreements between the two main parties and the situation with North Korea is constantly changing. Economically, South Korea's GDP is projected to become the fourth largest economy in the Asia Pacific region by 2016. Legally, South Korea still has problems with regards to data exclusivity, failure of multinational companies to maintain patent protection and the issue of legal courts favouring domestic companies and branded generic production. Demographically, South Korea has a fairly large population, which is over double the size of Australia or Taiwan. Although compared to many Western countries the population is not old, the elderly population is growing.

The implementation of the EU-Korea Free Trade Agreement (FTA) will provide EU companies with better access to the South Korean pharmaceutical market by paving the way for elimination of tariffs on EU pharmaceutical exports to the country. The volume and value of EU pharmaceutical exports are expected to increase with the implementation of EU-Korea FTA, posing a potential threat to US pharmaceutical exporters. The EU-Korea FTA also stipulates that South Korean authorities will be required to align their practices with international standards through an improved regulatory environment. In particular, the EU-Korea FTA will aim to ensure the strengthening of transparency in drug pricing decisions, as there have been concerns about the lack of transparency in the South Korean health authorities' price setting.

The biologic sector in South Korea is witnessing rapid growth. In the first half of 2011, a number of competitive strategies have been completed. Celltrion signed an agreement with Novacell Technology to develop biosimilars; Dong-A and POSTECH signed a MoU for co-operation on new biotechnology-based drugs; Il-Yang opened its new influenza vaccine plant in Eumseong, Chungcheon province; Korea Green Cross reported that its seasonal flu vaccine, GC Flu, had obtained WHO prequalification; Daewoong and Binex signed an agreement to jointly develop a biosimilar of Enbrel (etanercept); and Korea Green Cross and TEPIK announced a collaboration to develop and commercialise a cell culture influenza vaccine.
