ANVISA Resolution No. 855 of 2024 prohibits the use of all electronic smoking devices, including e-cigarettes, in enclosed public spaces, in accordance with the provisions of Law No. 9.294 of 1996. In Argentina, a 2011 government ruling prohibits the sale, advertising, distribution, and import of e-cigarettes and related products. Additionally, Decree No. 602/2013 classifies e-cigarettes as tobacco products, which means their use is banned in enclosed public spaces and on public transportation under the national tobacco control law (No. 26,687).
On May 20, 2024, Chile enacted new legislation governing the sale, usage, and marketing of vaping products. Key provisions include a prohibition on sales to individuals under 18 years of age and restrictions on the use of these products in enclosed public areas. To ensure regulatory compliance, oversight will be conducted by the Department of Health and the Regional Health Secretariats (Seremi). Enforcement measures may include health inspections, temporary closures, and monetary penalties. Fines will vary based on the nature of the infraction. For instance, the use of e-cigarettes in educational institutions may incur a minimum fine of CLP 137,000 (approximately US$ $ 146). At the same time, failure to display mandatory health warnings on product packaging could result in penalties of up to CLP 34 million (approximately US$ 3.6 million). In Colombia, e-cigarettes are subject to regulation but are not prohibited. Their sale, advertising, and use in public spaces are restricted; however, the purchase and personal use of these products-including those containing nicotine-remain legally permitted. In May 2024, Colombia enacted Law 2354 of 2024, establishing a regulatory framework for the consumption, sale, advertising, and promotion of electronic nicotine delivery systems, non-nicotine alternatives, heated tobacco products, and oral nicotine products (vapes). The law, which is an amendment of the Law 1335 of 2009, aims to protect public health-particularly minors under 18 and non-smokers-by introducing stricter controls. Additionally, the legislation mandates the development of health and educational programs to support tobacco use prevention and reduction efforts.
